6 pointsI posted this comment in a similar thread previously, but I've added some comments based upon the recent Supreme Court's recent review of prostitution laws which have some relevance to this question. An sp can legally refuse to engage in sexual activity with anyone they choose, regardless of the reasons. There are very, very good reasons for this. The question of whether an sp can legally refuse to see clients of a specific ethnicity also applies to whether they can legally refuse to see clients of certain cultures, nationalities, religion, age, gender, size, hygiene, manners, ability to follow instructions, reputation, previous contact... Every reason that's ever been discussed on CERB. You name it! They are legally justified. The Canadian Human Rights Act prohibits the "denial of service" based upon "race, national or ethnic origin, colour, religion, age, sex, sexual orientation, marital status, family status, disability...". Therefore if you only look at the Canadian Human Rights Act, you might think an sp cannot refuse to provide service to a client based upon race. However it's not that simple. Regardless of what the Canadian Human Rights Act says, neither the state nor a client can compel an sp (or anyone for that matter) to have sex with someone they don't want to have sex with. Why? Because compelling/forcing someone to engage in sexual activity conflicts with the sexual assault provisions of the Criminal Code of Canada. When there's a conflict between the Canadian Human Rights Act and the Criminal Code of Canada, the Criminal Code takes precedence. The Criminal Code protects the person who does not "consent" or want to engage in sexual activity, regardless of what their reasons are for not consenting. Even if their reasons for not consenting conflict with the Canadian Human Rights Act, they are protected by the Criminal Code. Society's goal of protecting people from prejudice is obviously very commendable. However, the harm caused by legally forcing someone to have sex against their will is greater than the harm caused to the prospective client by denying sex to them based on race or ethnicity etc. The Criminal Code of Canada provisions for sexual assault require that "consent" be given when engaging in sexual activity. Sexual activity without "consent", regardless of why consent is withheld, is sexual assault. The Criminal Code also states that "Consent" "requires the voluntary agreement... to engage in the sexual activity in question." If an sp felt legally "obliged", "compelled" or "forced" to engage in sexual activity with someone because of the Canadian Human Rights Act they would be engaging in sexual activity under "duress". In other words, there would be no "voluntary agreement... to engage in the sexual activity." This is the very definition of sexual assault. This is also a good example of why "No means no." Not, "No means no... but only if you have a good reason." There's a fundamental principle at work here. Neither the state nor another individual can compel us to do something with our bodies that we do not want to do, regardless of whether our reasons are reasonable or unreasonable. This is a very good thing! In addition, as the Supreme Court pointed out in its recent prostitution decision, laws which are designed to achieve a social good (for example the Human Rights Act) cannot be justified if they cause unreasonable harm to individuals. In this discussion, that would be a sex worker's right to decide what they do with their body and their right to freely give or refuse sexual consent and not feel obliged by law to engage in any sexual activity. As we are all aware, sex work should be a mutually consensual service. It is not the sale/purchase of a body for use by the client as they desire. (Which is how many opponents of consensual sex work would describe it). While the Supreme Court's decision focused on the prostitution laws which it was hearing arguments about, they had a lot to say about the safety and security of sex work and sex workers in general. Those comments can be read into the application of other laws as precedent.

6 pointsI personally do not care what colour people are but it is really not uncommon for people that are Indian or Black to ask me if I see them. I see everyone as long as they are clean and respectful. Multiple responses that I have seen over the years in multiple threads. -If the SP is indian or black and say she doesn't want to see people of her own color, it can be because they are sometime small communities and everyone know everyone and she doesn't want to be recognize. It seem especially for East Indian providers. -She may have a pimp. But to be honest, you CANNOT compare this industry to any other. Not food services, you cannot claim humans rights etc. A restaurant is public establishment that provide a service. An SP is a PERSON that provide a service. A person has feelings and preferences. You are kissing, touching, putting your penis in her vagina. this is intimate and cannot be compare. What if the SP may have try to have sex with black /indians/blue with red dots and is really not attracted sexually to them? In our civilian life it happen all the time that people states they may have sexual preferences for x races or y hair color. While I do understand it may be discriminatory you cannot ignore someone personal preferences. In my eyes... Would you enjoy having sex with someone knowing they are forcing themselves to be there with you?

3 pointsSo.... I have been watching a LOT of movies lately. LOTS. There have been great ones and not so great ones. There are valuable lessons to be learned from every movie that you watch.... here are a few from me. 1. Never trust a bald guy with a cat. (James Bond, Austin Powers) Lots of bald people on the planet. Lots of people with cats, too. You combine the two???? Deadly. Bald guys with cats generally belong to evil organizations that want to dominate the world. They have tanks filled with piranhas, sharks with lasers, ski teams with AK47's, and all kinds of other nasty things around their homes. Sure, they may seem polite and well spoken BUT... don't trust them. 2. Monkeys are fucking EVIL. (Planet of the Apes, 28 Days Later, Wizard of Oz) Sure they look all cute and such, but that's because they live in the jungle or if they are near people, we keep them in cages. Let those little bastards out and they will attack. In force. Super intellectual orangutans, brutish gorillas, scientific chimpanzees, rage infected baboons, winged gibbons... thank god we don't shave them and give them cats. 3. The 5 second rule does not apply to zombies (The Walking Dead, Dawn of the Dead... pretty much any movie that is premised on zombies and has "dead" in the title) Zombies are nasty. Sure they may have been humans at one point, but as part of their zombie union agreement, they had to forego the 5 second rule. So forget lying on the ground for a few minutes to make yourself less edible. You can roll around in dirt, cow poop, gravel, swamp slime... whatever... Zombies don't care. They'll still eat you. Bald, cat loving zombies started this practice. 4. Take off your glasses and become a different person (Superman I, II, III, IV, up to MCMLVXIII) It happens all the time. I walk around in my secret identity. I wear glasses to read. When I take them off, people wonder who I am. I put them on and they recognize me. Wear different glasses and I am different again. I take the different glasses off and I am the same unrecognizable guy. Superman was a genius... but not an evil genius. Superman had hair, and no cat. 5. When taking a vacation at a cabin, always take a large breasted expendable friend. (pretty much any horror movie, ever.) Here's the deal. We all know that psychos, axe murderers, chainsaw wielding demons, other-worldly beasts and bald guys with cats like to hang out in deeply forested regions with isolated cabins. Soooo... accompanied by a large breasted expendable friend, you go to the cabin. Send her in. She will explore the cabin whilst you unpack the car and do other things. If you hear a blood curdling scream (either coming from the dead animal filled basement or the really creepy cobwebbed upper floors), repack the car and leave. It's that simple. Ohhhh... and don't take a large breasted person that is actually likeable or has other redeeming qualities. Just take the expendable kind... I think they are listed on Kijiji. Sooo.... what are your life lessons???

3 pointsGreat post Malika ... in this business, everything else has to be trumped by the question of personal consent, which overrides other considerations. If someone is a racist, it's quite reasonable to say that their personal preferences don't trump the right of the customer to be served at a restaurant. But for sex workers, consent does override other considerations. While I agree completely that not seeing clients because of race, ethnicity, etc. is fundamentally distasteful, there may be reasons for the provider's choices. At the end of the day, however, it's hard to say they don't have the right to exercise those choices.

Every year at this time of year I ponder and I reminisce and I think and I throw the odd gin and tonic in there of course... and I think about the good times and the bad too....figure out what I have learned, what I need to change and take that forward into the next year. 2 pointsSex for a provider and all women is and should be a matter of consent. I believe they have a legitimate right to decide who they will entertain. I think it doesn't take too much imagination to come up with some very legitimate reasons why they might adopt such a prohibition. No one should condone racial prejudice, but I don't see this as a place where human rights should take precedence. I believe I've have had women decide not to see me because of my age, but I don't cry discrimination. You accept these things and move on, probably wouldn't be a good date if she really doesn't want to see you anyway.

2 pointsThere was a good article on this in the Ottawa Citizen yesterday, describing the model as driven by a particular kind of radical feminist ideology that portrays heterosexual males as aggressors and females as invariably victims, so it delegitimises women's options to offer sexual services on the grounds that women would only do so under some kind of constraint, physical, economic, social, etc. On the basis of ideological assumptions about what women's behaviour would necessarily be, proponents of the model decide that the exchange of sex for money can never be a freely chosen act on the woman's part. But this conclusion is based on a belief system not founded on empirical evidence. Feminist paternalism? How's that??

1 pointMy beloved Terrier passed over on New Years Eve. It was a peaceful passing, and she was really feeling the cold and deep snow, so it was her time. She bravely battled cancer and then more recently end stage heart disease. A true lover of cats, a matriarch of the house, the best dog you could ever ask for. I will miss her greatly, but she is now running in heaven with her family that passed before her. Heaven has a new angel. Bless you little one. I love you always! xoxo

1 pointI think that the main thing would be to just talk to the lady you wish to see, and explain the issue to them. this would serve two things. it would give the lady a idea of what to expect and it would also give you a chance to get to know the lady in question before the meeting. I do not mean to plan out every second of the date but just express you concerns and other things. a little bit of talking go a long way. :) Good luck and have a great 2014 TC

1 pointMy heart goes out to you. I've spent more than a few Christmas' in hospital watching over an ailing parent. My mom passed away several years ago and I feel it most at this time of year. As for teeth, I've broken two in the past 12 months. They are damned expensive things to get fixed. I often wonder why dental care is not covered under universal healthcare. Hang in there Jafo, things are bound to pick up in 2014. Till then know that your virtual family here at CERB has your back.

I withdraw the comment, and wish to rewrite it this way: one of the primary pieces of evidence put forth during the hearings is that Grandma's House, a place where street-based sex workers were permitted to bring clients during the height of the Pickton emergency, was shut down by VPD as a bawdy house. Alan Young successfully argued that the enforcement of this law compromised the safety of sex workers, and that piece of evidence, perhaps more than any other (in Young's opinion) was what convinced the court of the unconstitutionality of the three laws. At any rate, I think we can all agree that decriminalization itself is a noble goal; it's the political BS that comes afterwards (let's call it "recriminalization" for lack of a better word) that's the real problem. The first is a legal issue, whereas the second is a political issue. Shame they're so closely conflated on what consenting adults are permitted to do in private.

This is a business & therefore SPs have business principles regardless if we agree with them or not. Rather than being discriminatory, I prefer to call it "Selective Selling". :icon_wink:

1 pointFirst we don't know why the lady will see "White Gentlemen Only" Maybe racism. Or maybe as has been mentioned, she may run the risk of being discovered because her circle of acquaintances is a small non white community (hope worded right) or maybe as also mentioned, maybe something traumatic (PTSD) happened to her by someone of a certain non white ethnicity. Ladies in their advertising generally speaking post their photos, age, weight, body type etc etc etc. A gentleman looking for companionship but doesn't want to see a lady of a certain ethnicity can just do so from viewing ads without publicly stating he doesn't want to see someone of a certain ethnicity. He doesn't have to post "looking for white women only" But a lady not wanting to see someone of a certain ethnicity has only a couple ways to do it. First, post it in her ad, or second, in her contact form have the potential client state his ethnicity. And another spin on this. Would a gentleman who is non white really want to see a lady who wants to see white gentleman only. Because that could mean she is going to end up getting pressured to have sex with a man she doesn't want to have sex with. And that is the thin edge of the wedge to sexual assault. Irrespective of what we think of her advertising white gentlemen only, it is her body. And she, she alone gets to decide who she has sex with My advice is to move on, and be with a companion who wants to be with you. It sucks she restricts herself to white gentlemen only, but you also don't know why she has that restriction RG

1 pointSeems a bit harsh no? All he did was ask a simple question and you seem to have just dismissed it as common sense. To actually contribute to the thread productively, just do as was mentioned. If you think there might be a preference in race, just casually add it into your introduction and proceed from there. As far as I have seen, not many sps/ma's do this, but there is always the odd one that might. Happy hunting

1 pointI always tell a prospective provider that I am black. It is her RIGHT to refuse to see a black person. Disclosing my race serves two purposes : (1) it allows her to come up with a good excuse (for example, emergency in the family) to cancel the date and (2) avoids placing her in an uncomfortable position should she honour the appointment only to meet a black man. Brother, why are you confused? Don't you have confidence in yourself? NEVER allow any one to make you feel inadequate. If you are turned down, find another date. Cheers.

1 pointI haven't seen it much here, but on other erb websites, I've seen a lot of ads specifying "No Blacks, no east Indians". There is a reputation that these two races have certain unsavory characteristics (Not everyone of them, but a larger percentage compared to other groups). Whether it's true or not, I have no idea. On one occasion, despite having no comment regarding this on her website or her ad, I found out about an SP's no Blacks/No EI clients rule after she sent me an email asking for my background. After I told her (I'm EI), she cancelled, and that was that. It was a bit humiliating, but the best way forward is to forget and move on to someone who is willing to see you. All of the most amazing women I've met do not have this exclusion requirement, and I'm sure you'll find someone that meets your interest.

1 pointI had one lady that worked for me, she stated not to book black clients. It just happened to that she had a stalker who was following her from one end of the country to next, he was black. We never put it on her ad, as this would have sort of given her away in her hiding. But if I knew they were, or if they mentioned they were black, I simply did not book him with her. Now you can not tell " black" voice on the phone, so when the telephone confirmation would come in, she would listen to the voice to tell me yes or no. She hated to have to be like that, but is understandable in her case. She was in no way raciest, just extra cautious. She in fact loved black men. As an agent I respect the wishes of my girls, some are just not comfortable with other ethnic groups, and for a variety of reasons. There are some Gent's who also prefer no African/Canadian girls, or Indian or sometimes Caucasian too. I have 2 lovely black ladies that work with me from time to time, some of my black clients prefer not to book them....some of my Caucasian clients want to book them. It is at the end of the day, all about what they are interested in. Everyone deserves the right to choose who they prefer to spend time with. No harm meant by it. And as Fourtainateone mentions, at least it is on the ad so that you don't go through the booking procedure to find out that she prefers not to book.
