1. You can't always reach a conclusion about the law simply by reading the words on the page. Previous legal decisions have a significant bearing on how laws are interpreted going forward. 2. Before Bill C-36 was ever introduced, the Criminal Code had provisions prohibiting communicating prostitution services in a public place. Numerous cases turned on the issue of "communicating". These precedents affect how the current law is interpreted. There's nothing in the new law that appears to undermine these precedents. 3. The most important change introduced by Bill C-36 is that purchasing sexual services is now illegal (it wasn't before) and providing sexual services is still legal. The issues you're raising about communication, by the customer, haven't been significantly changed by Bill C-36. 4. It may be fun over a beer to debate the cadence of how the law is read "obtaining (pause) for consideration" or whether a phrase should or should not be hyphenated "obtaining-for-consideration". However in a court of law you're not likely to get to first base with these kinds of arguments. Very few judicial decisions turn on this type of grammatical analysis. 5. Finally, the specific facts of a case are always relevant to a decision. The law prohibits communication to obtain sexual services "for consideration" in any "place". In the example you gave of text communication, there might not be a violation of the communication provisions because the Criminal Code defines a "place" as being "covered or enclosed" (Section 197.1) and previous cases have determined that electronic communication etc is not a "place". But you have "obtain(ed) for consideration"... "the sexual services of a person" and your text is not only evidence of that, it's evidence that you've entered into a contract. Having said all this, in the real world most Police Depts. are only laying charges in cases involving exploited individuals (underage, trafficked, coerced etc.). The common advice to avoid legal problems is to seek out providers who are reasonably well known and do your due diligence to avoid any providers who you think may fall into these categories. I am not so sure that the drop off in activity here is attributable to people changing their habits because of the new law... I think the impacts of the law on this site has been more driven by how the rules around what we can or cannot say have been imposed. I totally get that at the start of all this the owners of this site needed to protect themselves so they acted to ensure their risk was managed and I assume they continue to do that and you know what that is certainly their right... I am just suggesting that these new rules have dramatically impacted the discussion here. Let face it this is a site about sex and the business of sex yet we can't actually talk about sex. This restriction on speech has made the discussion way less interesting so clients have less interest in hanging out and participating and frankly the strict application of the rules by the MOD (just doing his job) has resulted in the suspension or banning of a number of ladies who in the past tended to... lets say invigorate the discussion. So i think it's fair to suggest that the fear of the impact of being suspended has caused many to step back and if the ladies are not engaging then us guys quickly lose interest... we might come in and check the ads but we don't contribute like we used to. In regards to the way we treat each other and the impact that might be having ...I have been a member of this board for over 5 years now for most of that time I lurked in the background and listened and learned.. in fact learned a great deal. This should be an open forum with a few restriction put in place by council and the Mod so that everyone's voice is open to be heard but perhaps we just need to hear more voices. For an industry that has amazed me by the individual tolerance levels for diversity that its members demonstrate each day I have been somewhat shocked by the lack of tolerance for diversity of opinion that we as a group often show here in our posts. I said WE because i have taken some time over the last couple of days to review a number of my posts and have seen occurrences when my eagerness to post "my opinion" has meant that I have not always considered how the wording of my comments might be perceived by other on the board with different opinions. You will notice the legitimate providers do not ask you over the phone or via written communication what you would like to do in the time period (specific services). Follow their lead. If it is a sting - LE will ask you what you want for the money - if you don't identify specifically what you want, they will continue to ask you until you say I want $x for oxo. Just don't do it. Don't ever contact a lady and ask if oxo is included in the time together - you have just solicitated a service, which is against the law. Time and companionship. So far, as from what I have seen, it seems that most clients if caught in a sting are sent to John School. Again, the justice system is mainly going after those that are forcing others, pimping under aged, using violence and drugs - they are the ones getting real time. If you're seeing a consenting adult the chances of getting caught are vanishingly small. As soon as you start to involve anyone who's unwilling or coerced, or underage, then the chances of getting caught go up (because that's what the police tend to focus on, for obvious reasons) and I'd imagine the consequences would, too.
