Have a lawyer send a cease and desist letter - this alone will make them stop but it will cost you about 450.00 (plus the cost to get the info required to send the registered mail to and the agency owners name - this may require some investigation work or a court order for both ********** for the posters IP and a court order for the ISP to tell the lawyer who the owner of the IP was. (In other words you can get them to stop legally but it's expensive) if you already know the name of the person doing this go to the court house and register a small claim against them (usually about 75.00) and that is usually enough to scare them into not doing it anymore.

Prostitution is not illegal in Canada and this would NOT be considered public solicitation so arrested is not a concern but with anyone with really LOW (too good to be true) rates you can probably expect some type of "Catch"

Let’s start out by saying none of us are lawyers (or at least none of us are admitting to be).... Facts... Prostitution in Canada (If you follow the law) is legal. Prostitution In most of the USA it is not legal (Except for licensed brothels) Public solicitation is illegal in Canada -Includes streets -Includes hotel lobbies or hallways -Includes bars, restaurants, etc... (anywhere other than behind a closed door) Note: Grey areas include cell phone and pay phones as the lines are not encrypted but as far as I know no one has ever been charged for either. Some court cases back in the early 90's (or it may have been late 80's) made it legal for prostitutes to advertise services in newspapers - this is why you find explicit advertising in eye/now magazine and online on websites such as this and escorts-Canada (All media) in the USA they have laws against the promotion of prostitution and is why the guy in Ohio who ran the escort discussion board was charged yesterday... that and he ran some raffle for a free escort date and had some underage girls being promoted on the site as well (all around bad) Keeping or working at a common bawdy house (AKA: Bordello, brothel, whore house, in call location, massage spa offering extras, etc...) any place that is used for the common purpose of prostitution is illegal. For some reason the police usually leave the ladies who work by themselves without any public complaints alone but do go after high traffic locations, publicly signed places such as massage spas and any place that received a public complaint (usually due to drugs or heavy foot traffic in a residential neighborhood). If you advertise that you offer sexual services (even using abbreviations) and doing in calls you are putting yourself at risk but I have not heard of anyone getting charged for a common bawdy house in the last 12+ years who worked by themselves - but that is not to say it could not happen. Out calls to hotels are legal and safe (as long as your DO NOT discuss sex or anything outside of the hotel room - some area's will lure escorts to the lobby of a hotel and bust them for public solicitation so don't get fooled). You are best to always meet a new client at his/her hotel for the first encounter. If you feel a trust and the date goes well then offer them your private info but remember if you use your location as a common place of prostitution you increase your risk of acquiring this charge (so you need to read between the lines here as I cannot give you advise in this matter). Living off the avails (Pimping) is illegal and procuring (enticing people to get involved in prostitution so you can make money off them) is illegal in Canada. So Agencies if not careful can be charged for these. A agency in Canada must work for the ladies and cannot control the ladies in any way. They cannot tell the ladies when to work, how to work and they do not hire and fire them. When you are represented by an agency they are contracted by you (commission) for booking appointments, answer phones for you, placing ads, etc... (same as a band would use a booking agency to book gigs - and paid the same... when they get you a gig they get a commission). If the agency says "year she offers full service for $$$ and will do Greek for $$$$" this could be enough to charge the agency with living off the avails as they are admitting that they make money off of her doing sexual acts. Most of the time agencies do not get charged unless drugs are involved, pimping, violence, threats, forced sex, etc... Drivers can also be charged with living off the avails but I have not heard of anyone actually being convicted as the driver (personally I have not heard of this - someone did tell me a rumor about this happening but it sounded like the driver was also the agency manager and one thing is for sure - the stories get twisted fast in this industry). Technically you pay the driver for driving you but if they do not have a cab license they really have no business driving you to appointments for a payment (would not be a commission) so they could technically be charged with living off the avails. You give your friend gas money and buy him/her dinner for driving you around... well that could be another story. The laws are intended to protect the ladies and to protect the public. Some area's the laws have been known to be twisted around (like the hotel lobby entrapment to get the escort to discuss sex in public - this law was meant to get rid of street prostitution and has been used to entrap legit ladies - usually because of pressure from a municipal government from my understanding). The laws are to get rid of street prostitution and make the public (help protect land owners investments especially in the prostitution areas as the property values hit the ground when the street walkers move in) and it's to help get rid of the BAD people (pimps, violence and drug dealers) plus common brothels are not known for being clean unless inspected by a health and safety governing body (such as the ranches in the USA where the ladies have doctor visits and sti/std tests regularly and the location is under strict heath restrictions for clean environments - last thing you want is to jump into a bed with used sheets ... EWE) One thing I can tell you is that nowhere in Canada is it legal for a in call escort service. No matter what the municipality tells you if they sell you a license for a massage spa or a "escort license" you must understand that this is not a license to have sex or perform sex acts. Municipalities CAN NOT license prostitution but they want to make money off you or force you to leave the city... they sell you a LICENSE and make you believe that you can legally have sex in your location. If you do not have a license they can give you a municipal fine (Like a parking ticket) but if you get caught doing in calls (even with a license) and get charged with the common bawdy house charge than you are facing a criminal record and possibly jail time if they wish to make an example out of you. You best bet is to say "I am not a escort - I am a prostitute who advertises on escort related websites. Does your escort license allow me to perform sex and sexual services to my clients legally at this location?" they will say "No, a escort license allows you to advertise yourself in this city as a escort doing business at this location but you cannot have sex with clients" Your reply would be "Than I am not a escort by your definition as I have sex with my clients as I am a prostitute and your license would make it so I could not perform my job" and they will obviously try to bully you and threaten you as they want your money or want you to leave (Sounds like a pimp eh? - Yeah my thoughts exactly!!!) Anyway... hope that info helps... These are all my understanding of the laws and I am not a lawyer. I cannot offer you advise I can only share what I think is true (my personal opinions) - I would suggest speaking to a criminal lawyer. You will find other threads on the site (Search things like "Legal" and "Lawyer" and "living avails" and "bawdy house" and you will find all sorts of info here. Also read section 210 to 212 of the criminal code of Canada as it has info on prostitution and these matters (and you do not need to be a lawyer to understand them - they are worded well and pretty clear) My Advise: Talk to a real lawyer and don't take advise from people on a escort discussion board.. ;)

The media is so hard on the ladies and the industry as usually only the bad stuff is published and the general population likes to group all sex workers into one large pool. It's refreshing to hear someone in the media who has taken the time to see what our little community is really all about. I am sure if you look hard enough you will find underage prostitution online (I hope never on this site as we would remove anything that is even questionable and we ban anyone from the site who was here looking for that). The real problem with the underage prostitution is really the street level prostitution. Runaway girls who get mixed up with pimps and drugs. Unfortunly people think the internet is full of this (Mostly thanks to the media).

Remember that is in a different country. People often forget that Canada is much more liberal and such things as promoting prostitution are not illegal here. Other discussion boards in the USA have had similar problems in the past. If your worried about the police reading cerb or other discussion boards here in Canada I think you may be just very paranoid. I am sure some have read it but really what would be of interest to them here? Prostitution is legal in Canada where in most of the USA it is not (and is pursued/enforced as a major crime). Oddly enough I am in the USA right now (Down in southern Florida) and all over the place I see massage spa ads and massage spa's (This surprised me as it's been about 17 years since I made my way down here and previously I never say anything like this) so I was very surprised to see this.

The ladies are going to charge the most that they can in any area to make the income they wish to make. If the phone never rings they will lower the price but as long as they can maintain enough calls to acquire the amount they want to make each week the rate will be set. When they get too busy to handle the level of bookings the price goes up until that balances out again if they find that they are not getting enough bookings to maintain that income level they reduce the prices.

It is inappropriate to comment on the ladies rates here on cerb. Please if you feel the prices are too high for you keep your comments to yourself and your money in your pocket. Personally I would expect the rates to be higher in a small town as it has little competition compared to cities like Montreal. Just so you know Montreal is known across Canada for having the lowest average rates and the highest number of working ladies. This has caused a huge price war where everyone undercut everyone else until the industry average rate is so low the ladies do twice as many calls to make the same money and become unhappy working in the business (this effects quality of service) Let's face it... who is going to be happy working for 1/2 the amount of money that they should be working for!

That means you just recommended someone who is bait and switching people with FAKE PHOTOS chances are no one here will ever book with her now because of this. Now that you know this you should post a thread in the Bait and Switch section warning other guys that she is sending out fake photos. Others should be warned to stay away from this lady.

Goes to show you the type of people you are dealing with. What is really bad is that they are probably doing some affiliate referral program and the website that offers the affiliate program will be the one that looses the merchant accounts and not the ass who is doing the scam. But if the affiliate program allows room for a scam like this they need to fix it too. The credit card company hate chargebacks and if you say fraud they investigate.

You should PM the mod and let the moderator know as this member would most likely be banned. This has been tried many times over the years and sometimes when the ladies say no the guys post a negative comment and extort them for saying no (Another good reason why we have a no negative rule here). You need to call your credit card company and contest the charge (They will reverse it) tell the credit card company you did not authorize a charge and when enough people complain about this they will loose the merchant accounts. Chances are... if you don't contest the charges you will get MORE bills from them (Recurring charges) so make sure you call your credit card company.

I didn't ban her right away as I figured she would have shot herself in the foot. Anyone foolish enough to post a comment on a old thread about them in the bait and switch section was obviously going to spill the beans. Thanks Matt I am glad you found the post. I removed this from the Recommendation area and info the general discussion area. I had concerns with this from the first post so until some of the other members can add to this we will keep this lady out of the recommendation area for now. To me it looks like a shill but I like to give people the benefit of the doubt. Posting a fake photo of the lady really makes it a big no-no especially for the recommendation area. I agree, the properly run agencies bring added value to the table. Many of the ladies prefer to use a reputable agency and keep in mind the PK was not banned because of how they operate the agency. I commend them for using REAL photos of the ladies and for such a popular agency they have kept a fairly good reputation. An agencies job is to market the ladies and to work for them. No business exists that everyone loves, you will find people on both sides of the fence with everything.
