I beleive in 2010 Canada made it's own DMCA (Not sure if it just applies to music or not and that I assume is what the lawyer can tell us - if I had time I would go researching but I don't right now). If this 1968 law is still current then it would appear that news reporting does have a loophole. I don't know enough about this to be sure either way. I think in fair usage a credit (Like Maclean's did where they put "escorts-canada.com" under the photo) would be fair usage. APTN did not bother to do this. Instead they credited the site that STOLE the images from EC and the copyright notice is CLEARLY on the image. More then anything the site that stole all the images from EC is the real bad guy here and APTN by not taking the time to contact EC should be partially at fault.

That is not true, if someone publishes or redistributes any intellectual copyrighted material it is a punishable offense. Under Copyright Statutes & Digital Millennium Copyright Act (DMCA) the copyright owner is entitled to an injunction against the offending website or publication for each proven infringement. I am not sure if the media has some sort of loop hole or not but I guess that is what we need to find out. If another website copy's your stuff or your website they most certainly can be sued. Unfortunately most websites that would do this the owners are poor and you can't get water from a stone. Suing someone that has nothing to loose means you have nothing to gain - the only thing that you gain is the satisfaction of the offending website being removed and a lighter wallet. ... and a headache!

no, we would not give permission to anyone to reproduce the imges off the site. maybe some law exists for media to do this if they give credit. we will not know until the lawyer and the owner of the company meet next week.

APTN took images off that ottawaescort site and used them in the story. Problem is those images were stolen from escorts-canada.com by ottawaescort (EC does not own that site) the images CLEARLY show the escorts-canada.com copyright. The Toronto STAR contacted escorts-canada asking to use the images for the story and permission for using these images was denied by EC. No one from APTN contacted escorts-canada.com asking if these images could be used. This shows VERY poor journalism etiquette and I know EC has been in talks with the copyright lawyer over this. They had sent our cease and desist orders to the owners of this ottawaescort site (Along with a Winnipeg, Vancouver, Calgary and Edmonton site that were all stealing images and test from escorts-canada to use as content to these sites). I am sure they will be exploring further avenues with this infringement on APTN as well. One of the members on cerb (Lookingforfun7) apparently is claiming he is the reporter who wrote this story so we are helping EC look into this matter from our end as well.

Just so everyone knows... The titles of these area as " Courtesan / Escort Discussion " are because some jurisdictions (Winnipeg/Calgary/Barrie/Windsor... etc) all have municipal by-laws in place restricting "Escorts" from working in the city without a license. I have the Gen1 as well and love it. I don't need the camera so I don't plan to update any time soon (The faster chip is the only thing I really am interested in). First question would be why would you post this on cerb if you knew it would be deleted? Sounds foolish does it not? Second... animosity is a little strong. Anyone ever go to the fairbanks Hotel in Toronto?
