I respectfully dissent from the majority position. However despicable the alleged actions are, we are talking about minors. And they are not bordeline adults aged 17, but 15 year old. Minors are not considered adults in Canadian society, for good reasons. For example, they cannot vote because they are generally considered not to have attained the required intellectual maturity. If their alleged actions are proven in a court of law, they deserve to be punished. But they also deserve an opportunity to rehabilitate, and juvenile courts and detention centres will provide a better opportunity to do that. The victims and society would likely not be well served by their being judged and sentenced as adults. For one thing, it would have no deterrence impact on other immature kids tempted to act in a similar fashion as, again, they would likely not have the cognitive capacity to integrate such facts in their choice of action.
