Sudbury Sex Trial Resumes In April

The Superior Court trial of Michael Tomasik, who is facing a variety of sex-related charges including counsel a person to commit abduction, will resume in the spring.

Dates of April 5-7 were set Wednesday for the trial to continue after assistant Crown attorney Philip Zylberberg indicated the Crown had a new witness and wanted to re-open its case.

The Crown had finished calling evidence on Monday, but on Tuesday, the trial was delayed after a new witness surfaced.

The case was then delayed until Wednesday morning to give Zylberberg time to decide whether to call the witness.

Zylberberg said Tuesday that in the event defence lawyer Darren Berlinguette felt he needed time to fully assess his position if a new Crown witness was called, "I would not argue against such a position."

Tomasik is facing nine charges: counsel a person to commit abduction; counsel a person to commit a sexual offence; two counts of use telecommunications to arrange with a person to commit an offence; did make child pornography (written material that advocates or counsels sexual activity with a minor); and did transmit written material that advocates or counsels sexual activity with a minor.

He is also facing two counts of breach of recognizance (possessing or using a device that can access the Internet); and use telecommunications to agree with a person or make an arrangement with a person to commit sexual assault on a minor.

He is in custody after allegedly breaching his bail in February.

Two undercover cybercrime police officers have testified that Tomasik was interested in having sex with girls, getting them pregnant and having a family created by incest.

Meanwhile, two prostitutes told the Tomasik asked for their help in abducting girls and raping them.
