mod 135640 Report post Posted March 15, 2008 You almost have it right. -First municipal by-law revenue does not go to the province. It goes to the actual City. -Second... if you do not market yourself with the word "Escort" or "Massage" you do not fit into the definition in the by-law. -Third.... If you purchase a license it forces you to follow all these stupid rules and costs a small fortune. The reason for this is NOT a cash cow! It's to detour the ladies from buying it in the first place. They DO NOT WANT YOUR MONEY - THEY WANT YOU OUT OF THE CITY! If you think they do this for the money ... they don't! If you buy the license it gives the city a running capital to police the by-law with paid by-law officers (That is where the license fee's go... to pay the by-law officers to harass the license holders when they break the ridiculous by-law and to scare the non-license holders into leaving town or paying the license) They want you to work for an agency as that pushes you into a "Living off the Avails" area of the real criminal law. This way if they find you having sex you are not only breaking the by-law you are working for a agency so someone is living off the avails so a corporation would take a charge and anyone affiliated could. You need a non-profit company (A peer support foundation for sex workers). You define that the non-profit company is a peer support foundation for sex workers. When you openly admit you are a prostitute (sex worker, callgirl, service provider, etc..) then you do not fit into the definition of "Escort" defined by the by-law. Therefore you do not need a license and you do not have to follow the silly by-law. The city will not change the by-law to pertain to sex workers (that would make the city the pimp if they openly admit you are having sex and they are making money off you having sex). If just a few of you get together you could do a lot of good for each other. You could benefit from the things the agencies benefit from (Group advertising, security as you could set up a system where you let someone know when you are doing a call, etc.) The last thing the city wants is for you ladies to get organized and stand up for your rights! You do have rights but your being bullied... the problem is... if you group together it would probably get worse before it gets better. They would try every trick in the book so it would not hurt to quietly get enough of you together and put aside some money for a lawyer who can work with you. Has anyone else been busted? Second - I just want to voice my opinion that I find this all ridiculous. In a city which boasts some of the highest crime rates in Canada (per capita) like yesterday's headlines "No. 3 most dangerous places to live", Nearly daily shootings, gang violence, car thefts, robberies, etc. All of these leave victims and mourners. Now provided that the ladies on EC aren't forced against their will to advertise and meet people, who is the victim? Two (or more *smile*) consenting adults who in the end both walk away with a smile on their faces. So if you ask me, it seems like such a waste of police resources. How many police would have been tied up throughout this entire process - not just the one who got to enjoy the company and a free drink on the taxpayers, but all the rest involved in who waited around to be able to make the bust. Just had to add my 2? in. Finally, another downside to this, is I am certain this will further reduce the chance that skinnieminnie will have her own advertisement (complete with a few pics) on EC. More tax payers money if I had taken him up on it. I even told him I'm not really a drinker but I'll have one with him. I nursed it while he downed his. I told him go ahead and order another while he waited for me to finish mine. The bartender gave us our bill, told him just to put his room # on it. which at first he did. Then grabbed it and said of never mind I should give you this and gave his CC. Which I'm sure he'll be reimbursed for. When the vice was taking me to the car, the female officer asked me if I at least got a drink out of it. I said yes, didn't really want it, I quit drinking. My business gets broken into and it takes 16 hours before the cops show up and another 24 before the Ident. Unit shows up because they are "undermanned", but they've got manpower for this nonsence. You've all made good points and Mod has definitely provided some valuable information on this subject. What a legal rat's nest that is. My only comment regarding some of the ideas regarding setting up "home businesses", non-profit organizations, etc. is be very careful and do your homework. I'm not an expert but depending on your situation the city may need a business licence for your "home based business". This then may open the door to provincial sales tax people visiting. Then the GST people come. Even if you don't have to pay or collect these, they may still visit to check up on things. I know PST checks on us occasionally. If you have a "home business" registerred then CRA will want a return done. For CRA you will need records, client lists and invoices. The situation with non-profit organizations can be just as cumbersome. I have a couple of freinds who sit on the boards of non-profit corporations and they have to be very precise in their reporting to CRA and the province. They can only hold so much in assets, etc. Perhaps what I'm saying is not 100% applicable to your situation. All I'm saying is make sure you check out everything before making any decisions. Just make sure you aren't jumping from the frying pan to the fire. In the meantime I think the best advise is to take it easy. Only see your regular clients or those with a solid referral. Maybe they think, they'll get busted having been near me. Those bastards, (not clients) but the whole system. They are making my income a little scarce these days. I do have to say thanks to my true blue regulars, they have been keeping my head above water. I'm going to wait and see when I go into meet with a woman on the 25th about hooker camp what she has to say about this. I have a list a mile long of questions to ask. mod 135640 Report post Posted March 18, 2008 You know... a group sit down with a lawyer may be a good idea. I bet most of the ladies in Winnipeg who advertise online have legal questions! If someone took the time to find a lawyer who knows this law well in Winnipeg and pitch a "group" rate for a few hours to ask questions he/she would give you a rate and then you just need everyone to contribute. I know first hand that in Toronto they have a strip club owners association that does this type of thing. They have a yearly membership fee (it's non-profit) and they meet to discuss laws and use the fee's to pay for legal consulting and even court battles. You also have such groups as "Exotic Dancers Rights Association of Canada" and even sex workers have groups like spoc (Sex professionals of Canada http://www.spoc.ca/) who are fighting for better rights for sex workers. Now you may not agree with changing the law (as we all know that could go either way and backfire on everyone) but most groups for sex workers just want a safer working environment and some better guidelines made so no one takes anyone else's rights away from them. Now SPOC is challenging the criminal code here in Canada (April 2008 is the court date) and they are fighting the bawdy house, avails and communication laws in court. They have valid points as to why they wish to protest the law as they wish to make it safer but the criminal court of Canada could simply say... "Your right, it's unsafe we need stricter laws" and make things worse for the ladies or open up more gray area's that can be exploited by bad people. I am hoping for the best as our supreme court judges try very hard not to pass laws based on moral reasons and human rights and public safety is valued very high ... but you never know! I was given probabation and thankfully a conditional discharge (I think it was called) so that it came off my record 2 yrs or so later. I was investigated due to my own naturopathic drugless practitioners board directing a complaint to the police and not by my neighbours who had no idea I was doing incalls.. being so obviously the 'girl next door innocent looking type'... ha ha. Now.. what's interesting to note is that recently a good friend of mine in Ottawa had police show up at her door because a neighbour made a complaint after her son recognized her from her website. The police told the neighbour basically to mind her own business and that my sp friend had the right to do what she was doing. This is due to the court case involving the swing club in Montreal.
