Were they fined for being open before the 4th? Or is it in the interpretation?

 

Effective May 4, and at the further direction of their respective regulatory bodies, regulated health professionals, such as dentists, dental hygienists, chiropractors, physiotherapists, optometrists and podiatrists will no longer be limited to providing urgent and emergent care. In addition, individuals who provide therapeutic massage and acupuncture services may resume providing those services.

 

It looks like Johnny Law is calling them a bodyrub so they're not included in phase 1.

Exactly.  From the CBC report, "The health department's report on establishment closures does not list a reopening date for the business, which it describes as a body rub parlour."

Interesting as there are several other “body rub” establishments open and they’re not getting shut down. I wonder if they targeted EB specifically because they refused to close to begin with. Curious to see if the others get shut down. Wonder if there will be any recourse against those who patronized “body rub” places during this first phase.

I don't think they would go after clients. They were there for a massage and massage is listed in phase 1. They'd have to prove you knew the difference between therapeutic, relaxation, or whatever kind of massage. The wording doesn't mention RMT's or anything.

 

Isn't EB a city licensed body rub? That's maybe how they got nailed. Crystal and the like have massage in the name.  Semantics is a bitch. All I know is I don't want to be on the table when they barge in and ask "Is that a therapeutic handy j or an amateur rub?".

I think its too risky to go any place right now even if they are open.  My apologies not making myself clearer

you mean EB never shut down through this whole period ?   what about the other studio on Sargeant, the old Nevada's ?   they still open ?

My understanding of the difference between Bodyrub and Holistic is that bodyrub doesn't necessarily infer or suggest a therapeutic type massage or a requirement that the masseuses be licensed or certified in massage.  However if I went into EB and asked for a therapeutic massage experience I'm sure the girl would provide it.  I believe EB should contest this fine in Court.  They provide a massage service.   In some cities like Vancouver and Toronto a Bodyrub license can cost A LOT more than a holistic license, in Toronto a bodyrub license costs over $ 10,000 per year.  Does anyone know how much a bodyrub license in Winnipeg costs?    So was EB warned to shut down and then they refused and then the fine ?

hope this clarifies things as it does for me somewhat, according to City of Winnipeg, a Bodyrub is not considered a Therapeutic treatment, so that category is not named to be allowed to open yet.

The definition of a body rub practitioner does not include:

  • A massage therapist
  • An individual who carries on a business or occupation that is limited exclusively to massaging of the feet, hands, head or face
  • A Provincially certified esthetician who administers massages as part of a skin care treatment, where the massage is for the purposes of product application and is a minor or incidental and secondary part of the treatment

so a Bodyrub Parlour or Escort Agency is looking at almost $ 5000 for a Business license per year so a $ 2500 fine hit is like the license fee for 6 months !

Diamonds was open during the outbreak but closed last week on the heels of the EB fine and closure.

Probably decided they didn't want to get fined either.

you can't be serious, you mean Diamonds was open during April ?   cause you know what might happen now, now that the Government knows these spas thumbed their noses up at the laws, they'll make sure they don't open till the end of the very last Phase like maybe September or later.

I can't speak for the early part of the pandemic but I know for a fact (not "I think") that they were open in Mid April up to a week or so ago when EB/TO was busted.

I haven’t been there in forever, but from what I was told. When the city asked people to close (e.b did close), but they did open up that one week I heard to soon ( I think they assumed they fell into that category by mistake or who knows). But they did remain close the whole time before that ( from what I was told ) 🙂
