mod 135640 Report post Posted December 13, 2012 The loophole right now is that the criminal code that this falls under is being questioned in Ontario so the police forces are really turning a blind eye to it all from the looks of it until the higher powers get something done. The law still stands so you can still be charged but I doubt any judge would hear the case till the laws are adjusted. Is it illegal right now? Very much so. If prostitution takes place in any PLACE (even a hotel room) it could technically be considered a bawdy house. (if you only saw ONE client at the hotel room then left it is no longer "common" so that makes it legal. (Multiple people working from the SAME hotel room however... instant brothel technically). Swingers clubs is a loophole that some massage like places capitalize on... It is legal to charge a membership fee but if sexual acts are taking place the people participating in the sexual acts can not be doing it for financial gain (prostitution) swingers clubs are only legal if the members are not negotiating paid services. For instance if you had MEMBERS ONLY swingers party and everyone paid a "membership fee" and consenting adults had sexual conduct during this party without exchanging money... that is legal (it's the prostitution part of hosting events that is illegal). You just need to be careful with that too as say you hire a "hostess" or "host" and that hostess is paid by you (the even organizer) and the hostess or host get involved in any sexual activity then that could be seen as prostitution making the entire party illegal. I do not believe the event organizer can participate or pay anyone involved in any sexual act.... but I am no lawyer so this is something you would want to discuss with a lawyer first if you are concerned with legalities of such an event. 2 Quote Share this post Link to post Share on other sites
