backrubman 64800 Report post Posted February 10, 2013 Hard to say what really happened without being there, I have to believe the flight attendants and flight crew are trained on how to react to incidents like this. Using their training and experience they took what they thought was the most prudent action. Obviously "smoke" was involved but there is no evidence and the charges dropped. So the family could argue that Sun Wing was diverting due to smoke (which it can't be proven they were responsible for). As reprehensible as abusive language to a member of the flight crew and failing to obey a lawful order to return to your seat is, it is hard to imagine that these two remaining incidents would pose enough of a continuing risk to safety to justify diverting. Unless their lawyer got his credentials out of a bubblegum machine, Sun Wing is likely to lose which would make other flight crews more hesitant to divert and land as soon as possible when perhaps they should and Sun Wing would probably be spending another $50k to bring the law suit.
