The lady whose picture they are using can actually sue the agency. It's against the law in The USA to use someones picture with out their permission. Could also be classified as slander, especially if they use a MA's pic for a FS SP since it would imply the individual in the pic offering a non-advertise service. If you use someones photos they can take you to court but really if your suing someone who has nothing you leave the courtroom with empty pockets as it costs you money to go to court and if they have nothing your not going to leave with anything. If they own property (car, house, etc..) it may be worth it because you can put a lien on any of those things if they refuse to pay the judgment (again this costs you even more money) but when they go to sell the car or sell the house you would eventually get some (or all) of your money you sued them for. Often you walk away with a judgment in your favor but nothing to show for it. Good news is a cease and desist letter is usually all you need as no one likes to go to court - especially the hosting companies or websites where your photo has been used. A simple cease and desist note on your lawyers letterhead will usually get the photos down from the person who posted them! but you should have 2 copies sent (a copy to the person and a copy to the company that owns the site or the company who owns the web server it is on and is hosting the site) It will however cost you upwards of 400.00 for your lawyer to send out the letter.
