captain 160 Report post Posted October 6, 2007 hey, in this thread here http://www.cerb.ca/vbulletin/showthread.php?t=1993 Mod said You can legally discuss money in exchange for sex in Canada as long as you do it in private. Street walkers, public meeting places and even cell phones (but that is pushing it) are all considered public places so, that begs the question - and not that it concerns me, but just tryign to sue the discussion forums for what they are here for..... why can't we discuss what the girls can/can't do on a date with an agency, or when talking directly to the SP - if I am in the privacy of my house / car / office / hotel and she is in a private room - why is our conversation illegal. (meaning to the poitn where if you talked to say jason or jessica at PK and they can't really go into details about what the girls will do...or for how much.... it seems to be it contradicts the law a little? not sure if I made that clear, lol. just a passing thought. mod 135640 Report post Posted October 7, 2007 If you spoke to the actual lady then it would be legal. If the agency sells a sex service however then they are "Living off the avails" and could be prosecuted as a pimp so they are not legally allowed to acknowledge in any way that sex is included in the price. See the agency is just suppose to be a "Reception service" for the entertainer (Booking agent) they are paid to take care of the advertising, phone calls, screening, drivers and accommodations (usually) and all other clerical work. They are not suppose to know what happens during the date. This is one of the reasons our sex laws are being challenged here in Canada as it would be much better if the agencies could admit to this and offer the ladies condoms, safe sex consulting and many other things... but the law makers don't want to make it easy for pimps so this gray area law helps the law be able to charge any agency (intention is obviously to give the police the power to bring down the true pimps but the public is so poorly educated when it comes to law in general that they often abuse this to look good in the public eye... yeah we busted XX number of illegal prostitution rings - just before election time... you all know the drill). Bottom line, the agencies can not legally sell sex. Look up the criminal code law (Section 212 - you can easily find it on line using goggle) and read it. You do not need to be a lawyer to read it, it's written in plain English and you will understand better when the agencies can not discuss sex acts. Jessika can speak here much more openly cause this is a anonymous chat forum and to prosecute her from something she said here would require the law to obtain a court and deliver it to our isp (Hosting company) and make them hand over the ip logs and then get another court order for her isp and make them hand over the logs as well and then compare them (Not likely since the logs are HUGE and this would just not be worth the effort and expense - especially since our ISP is intentionally in the USA and not in Canada). hope this helps. JoyfulC 132299 Report post Posted October 7, 2007 The other thing to consider is, are you looking for an incall? While incalls are broadly tolerated in most Canadian cities that don't require escort licensing, it does pose a problem in that explicit discussions may incriminate the provider with respect to bawdy house legislation. What I want to know is why do some guys insist on being so explicit? Is it just the thrill of talking about sex acts on the phone? It's not like you have any guarantee. Someone can (and will) tell you anything over the phone to get you and your wallet in the door -- but may or may not deliver. But on the other hand, someone who is discreet (to the point of losing business if necessary) is probably going to be best trusted to protect your privacy too. Why not just show up and take your chances? From everything I've heard and read on these boards, I'm not sure that discussing explicits up front really results in a higher degree of satisfaction. ..c..
