It is tragic that this case was probably lost because they went for 1st degree murder, instead of something like manslaughter. She was a sex worker and indigenous, and the jury was 80% male, in Alberta (no offense) they were overly optimistic to think anyone was going to view this as a 1st degree murder. cinelli 22184 Report post Posted April 3, 2015 First Degree Murder is very difficult to prove. It applies to premeditated, planned killing and is rare. Prosecutors would need clear evidence that the killer intended to kill his victim. An example would be a gangster killing a rival gangster, or witness who was going to testify against him in a major trial. The prosecution was wrong to seek it in the Gladue case. I do think the defendant should have been guilty of manslaughter. A large wound like that was not accidental or a normal consequence of rough sex. Hope the Crown appeal is successful.
